1. General Provisions

1.1. These Terms and Conditions govern the use of the iSend.az platform (“Platform”, “We”, “Company”) and define the rights and obligations of both parties.
1.2. By using the Platform, the user (“User”) fully agrees to these Terms and Conditions.
1.3. If you do not agree with these Terms, you must not use the Platform.
1.4. iSend.az, developed by ERA Innovations LLC (ERAsoft), provides automated WhatsApp bulk messaging, customer contact management, API integrations, and analytics tools for businesses.

2. Description of Services

2.1. The Platform provides the following core functionalities:

• WhatsApp bulk message sending (Bulk Messaging)

• Contact and message list management

• Message templates and scheduling

• Multi-number (multi-account) support

• Delivery analytics and reporting

• API integrations and automation tools

2.2. The Platform may only be used for lawful purposes. Users are strictly prohibited from using it for spam, fraud, abuse, harassment, or any form of illegal communication.
2.3. The Company reserves the right to modify, suspend, or remove features without prior notice.

3. Registration and Account Management

3.1. Registration is required to use the Platform. The User must provide accurate and up-to-date information.
3.2. The User is solely responsible for maintaining the confidentiality of their login credentials and account information.
3.3. If unauthorized use or security breaches occur, the User must immediately notify iSend.az.
3.4. The Company reserves the right to temporarily or permanently suspend accounts involved in suspicious or non-compliant activity.

4. Payments and Packages

4.1. All iSend.az services are prepaid. Packages are activated only after full payment.
4.2. Once payment is confirmed, the User’s balance or subscription limit is activated.
4.3. All payments are non-refundable. Even if the User’s WhatsApp number is banned or limited by WhatsApp, no refunds will be provided.
4.4. In case of a ban, the User may remove the blocked number and add a new one to continue using the package.
4.5. Payments can be made via bank card, transfer, or other supported online methods. The Company is not responsible for the operation of third-party payment systems.

5. Message Delivery and Risks

5.1. Due to WhatsApp’s policies, there is a natural risk of account suspension or banning during bulk message sending.
5.2. To minimize this risk, Users are strongly advised to:

• Limit recipient lists to no more than 100 contacts per campaign;

• Use different message texts and templates for each batch;

• Schedule messages with reasonable time intervals between sends.
  5.3. iSend.az is not responsible for any number bans, delivery delays, or message failures.
  5.4. The Platform only provides a technical tool. The User is fully responsible for the content, purpose, and consequences of all messages sent through the system.

6. User Responsibilities

Users agree to:

• Use the Platform only for lawful communication;

• Avoid violating privacy or intellectual property rights of others;

• Refrain from spam, harassment, or offensive content;

• Use legally obtained contact databases;

• Not exploit system vulnerabilities or disrupt Platform operations.

The User bears full responsibility for any legal consequences arising from misuse of the service.

7. Company Rights and Responsibilities

7.1. The Company strives to ensure uninterrupted and secure service delivery.
7.2. The Company is not liable for service interruptions caused by technical failures, third-party system issues, or changes in WhatsApp’s policies.
7.3. The Company may modify, limit, or discontinue service functionality without prior notice.
7.4. The Company processes personal data in accordance with the Privacy Policy and never sells user data to third parties.

8. Intellectual Property

All platform materials (software, code, design, interface, logo, and documentation) are the intellectual property of ERA Innovations LLC (ERAsoft) and are protected by copyright law.
Users are prohibited from copying, sharing, or reselling any part of the Platform.
Users are solely responsible for all message content and legal implications.

9. Limitation of Liability

9.1. iSend.az provides no guarantee of message delivery, WhatsApp uptime, or number safety.
9.2. The Company and its employees are not responsible for losses arising from bans, delivery issues, or third-party restrictions.
9.3. The Service is provided “as is” without any warranties.
9.4. The Company shall not be liable for indirect losses, business interruptions, or third-party claims.

10. Service Modification and Termination

The Company reserves the right to change, suspend, or terminate the Platform or its terms at any time without notice.
Continued use of the Platform implies acceptance of any such changes.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Azerbaijan.
Any disputes shall first be resolved through negotiation. Failing that, disputes will be settled in the Baku City Courts.
